TOUR PRICE
All prices are per person in Canadian Dollars unless otherwise stated.  Although every effort is made to maintain published prices, JK Tours Inc. reserves the right to adjust prices should it become necessary.  Prices are not guaranteed until a deposit has been received.

Unless otherwise specified, the tour price includes all scheduled transportation during the tour, all accommodations, meals as specified in the itinerary, entertainment or sightseeing as specified in the itinerary, and the services of a JK Tours Inc. tour director.

ITEMS NOT INCLUDED IN TOUR PRICE

ITINERARIES
JK Tours Inc. reserves the right to withdraw any tour outlined, or any part thereof, or to make alterations or changes in itineraries as deemed necessary or desirable.

RESERVATIONS & PAYMENTS
Unless otherwise specified, a non-refundable deposit per person is required within 7 days of booking to hold a reservation.  Final payment of the balance is due no less than 45 days prior to departure.  Any reservation made less than 45 days prior to departure is subject to availability and must be paid in full at time of booking.  JK Tours Inc. reserves the right to cancel a reservation if payment is not received as requested and withhold any payments already received.

PASSENGER CANCELLATION
Regardless of reason, notice of cancellation must be made in writing to JK Tours Inc. and will become effective from the date of receipt in our offices in Moncton, NB.  In the event of cancellation by you, the following penalties will apply:

A passenger canceling while a roommate or roommates remain constitutes a cancellation of one type of accommodation and the rebooking of another.  The price charged the remaining roommate(s) is the new, higher price for the new accommodation.

JK TOURS CANCELLATION
JK Tours Inc. does its best to operate all tours listed but occasionally it is necessary to cancel a tour.  JK Tours Inc. reserves the right to change or cancel a tour at any time for any reason.  Should a tour be cancelled or inoperative we will inform you as soon as possible about the cancellation and, where available, offer a comparable alternative.  If an alternative is not available you will be offered either a full refund of monies paid by you to JK Tours Inc. or a transfer of monies paid towards the cost of another JK Tours Inc. tour.
JK Tours Inc. is not responsible for additional expenses that may occur as a result of changes or cancellations, such as passport fees, insurance premiums, clothing or equipment purchased for the tour, other travel arrangements not made through us, or any other expenses that may occur as a result.

JK Tours Inc. accepts no responsibility for any costs incurred or losses sustained as a result of cancellations, delays or interruptions of tours caused by weather conditions, sickness, strikes, war or threat of war, quarantines, Acts of God, government actions, terrorism, mechanical or technical problems of any vehicle, aircraft, vessel or other instrumentality, or any other events beyond the control of JK Tours Inc.

PASSENGER RESPONSIBILITY
All passengers assume the responsibility to select the tour most appropriate to their physical abilities and interests.  Passengers are responsible for being in sufficiently good health to undertake their trip; for obtaining the appropriate medical and cancellation insurance; for studying all pre-departure information; and for acting in a manner considerate of fellow passengers and locations visited.

JK Tours Inc. regrets that it cannot provide individual assistance to a passenger for walking, dining, getting on or off the coach, or other personal needs.  In such circumstances, the passenger must be accompanied by a companion who is able to administer any necessary assistance.  It is the passenger’s responsibility to advise JK Tours Inc. at the time of booking if traveling with mobility aids such as a walker, wheelchair, scooter or guide dog and/or of any special needs.   JK Tours Inc. accepts no responsibility for special arrangements, problems or costs incurred by passengers physically unable to participate in planned activities.

JK Tours Inc. reserves the right to remove from the tour, at the passenger’s own expense, anyone whose inappropriate actions or conduct create a hazard to himself or herself or others, or otherwise adversely impact the operation of the tour or the rights and welfare or enjoyment of other passengers.

CHILD POLICY
Apart from designated family programs, we require all passengers to be at least 16 years of age.  Passengers under the age of 18 must travel with a parent or guardian.

LUGGAGE ALLOWANCE
Unless otherwise indicated, passengers are allowed one (1) average sized suitcase per person.  Additional luggage will be accommodated only if space allows and an additional cost may be charged.  JK Tours Inc. reserves the right to deny excess baggage at point of departure.

On those tours where luggage handling is included, luggage tags will be provided to identify your bags.   Carry-on luggage remains the sole responsibility of the passenger at all times.

LUGGAGE DISCLAIMER
While every effort is made to treat passenger luggage with utmost care, passengers must ensure that luggage is in a condition sufficient to withstand the normal loading, unloading and delivery process.  JK Tours Inc. is not responsible for and does not assume liability or accept claims for loss of or damage to luggage due to breakage, theft, or wear and tear through hotel and group carrier handling.

UNUSED SERVICES
Adjustments will not be made for unused sightseeing trips or meals.  Passengers leaving the tour during operation will not receive a refund of unused services.

SEATING
All seating is subject to availability and will be assigned on a first-come, first-served basis.  Specific seats will not be held until a deposit has been received.

ACCOMMODATIONS
Room assignments are made on a first-come, first-served basis.  In most cases, JK Tours Inc. reserves hotel rooms with two beds. In some cases, the availability of smoking rooms may be limited.  The right is reserved to substitute hotels should this become necessary due to circumstances beyond our control.
Triple and Quad Rooms - Triple and quad rates are based on three or four passengers sharing one room with two beds. Parties of three or more may request additional beds or cots, but these requests are subject to hotel availability.  Triples and quads are not recommended for comfort. 
Single Rooms - Since hotel rates are per room, the tour price for rooms occupied by one passenger is higher than those where two or more passengers share the cost of a room.

MEALS
Meals are not included unless specified in the itinerary.  All meals not listed are at the passenger’s expense.

SPECIAL REQUESTS
Specific requests, such as adjacent or connecting rooms, bedding requests, smoking or non-smoking rooms and special dietary needs should be advised at time of booking.  JK Tours Inc. will endeavour to secure your special request, however requests cannot be guaranteed. 

GRATUITIES
The customary tips to drivers, step-on guides, local guides, and JK Tours tour director are not included in the tour price and should be extended on a voluntary, individual basis.

INSURANCE
Travel insurance is not included in the tour price and must be purchased individually from a reputable insurance provider.  JK Tours Inc. strongly recommends the purchase of travel insurance in the event of medical emergencies, lost luggage, a cancelled tour, or any other unforeseen event.  Passengers should consult any existing policies and consider if supplemental coverage is required.

PHOTOGRAPHY ON TOUR
JK Tours Inc. reserves the right to take photographs during the operation of any tour.  On occasion, these photographs may be used for promotional purposes.  Participants who prefer their image not be used for promotional purposes are asked to make their request known to JK Tours Inc. in writing during the booking process.

SMOKING AND DRINKING
In accordance with federal and provincial laws, smoking and the consumption of alcoholic beverages is not permitted while on the coach.  Comfort stops are made every 2-3 hours giving passengers the opportunity to smoke.  Please note that in some instances, hotels may be smoke-free or have limited smoking rooms available.

TIMES
Pick-up times, departure times and locations will be communicated to all passengers throughout the tour.  For the convenience and enjoyment of all tour members, it is important to adhere to these times as strictly as possible.  Failure to adhere to these times may result in interruption of services.  The responsibility for rejoining the tour after willful neglect of a departure time lies solely with the passenger.

IDENTIFICATION
Canadian Citizens must carry a valid passport or a birth certificate and government issued photo ID (such as a driver’s license) for tours to the United States.  Other Canadian residents may face more stringent documentary requirements.  Proper identification is the responsibility of each passenger and JK Tours Inc. will not be held responsible for passengers denied entry to the United States or re-entry into Canada.  To facilitate border crossing, please keep your identification with you and not stowed in your luggage.

DESCRIPTION OF SERVICES
JK Tours Inc. has made all reasonable efforts to give an accurate description of the tours at the time of publication.  Inevitably, the occasional error or changes since publication may occur and we therefore cannot guarantee the accuracy of every detail.

LIMITS ON JK TOURS’ RESPONSIBILITY
JK Tours Inc., its directors, officers, employees, agents or representatives (collectively referred to as “JK Tours Inc.”) hereby give notice that they act only as agents for hotels, transportation companies, land operators and suppliers of travel services, and assume no responsibility or liability whatsoever in connection with the operation, safety condition or service of any aircraft, motor vehicle, boat, other conveyance, inn, lodge, or hotel which may be used wholly or in part, for services to JK Tours Inc.’s passengers.  JK Tours Inc. will not be responsible for any act, error or omission, nor for any injury, loss, accident, delay, inconvenience, irregularity, or damage which may be occasioned by any cause whatsoever, including Acts of God, civil disturbance, government restrictions, or failure of any means of conveyance to adhere to published schedule.

ASSUMPTION OF RISK & RESPONSIBILITY
You are aware that during the tour which you are choosing to participate in, you are subjecting yourself to certain risks, including but not limited to: weather, forces of nature, and transportation by coach, automobile, train, boat or other conveyance.  You acknowledge that you have received no information from JK Tours Inc. that in any way minimizes the risks for such travel.

In recognition of the inherent risk of the travels and related activities in which you are intending to engage, you confirm that you are physically and mentally capable of participating in the activity, that you are willingly and knowingly electing to participate in this tour in spite of any potential risk of danger, and you willingly and voluntarily assume full responsibility for any injury, loss or damage suffered by you or caused by you, whether caused in whole or in part by the negligence of the owners, directors, agents, officers, employees, contractors or subcontractors of JK Tours Inc.

RELEASE OF LIABILITY
In consideration of the services and arrangements provided by JK Tours Inc., you, for yourself and for your heirs, personal representatives or assigns, do hereby release, waive, discharge, hold harmless and agree to indemnify JK Tours Inc., its owners, officers, directors, agents, contractors, subcontractors and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occurring during your travel in connection with the scheduled tour and any activities conducted in conjunction therewith.  YOU SPECIFICALLY UNDERSTAND THAT YOU ARE RELEASING, DISCHARGING AND WAIVING ANY CLAIMS OR ACTIONS THAT YOU MAY HAVE PRESENTLY OR IN THE FUTURE FOR THE NEGLIGENT ACTS OR CONDUCT OF THE OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS OR SUBCONTRACTORS OF JK TOURS INC.
